Visa

If you are a nonimmigrant desiring to enter the United States for a temporary period of time, a visa is required. The type of visa you need is determined by the purpose of your intended travel, such as entry for business, pleasure, medical reasons, or education. Permanent Residents

If you are a U.S. Citizen, Permanent Resident (green card holder), or even a victim of a crime or abuse, the attorneys at the Levers Law Firm can file the necessary documents for you to sponsor yourself or your relative to obtain permanent residency. A citizen may file on behalf of a spouse, parent, child or sibling. A green card holder may only file for their spouse or child. Citizenship

If you have been a permanent resident for five years (three years if married to a U.S. Citizen) and have been a person of good moral character you may be eligible to apply for naturalization to become a U.S Citizen. However, in some cases if you have been arrested or convicted of a crime it is not advantageous for you to apply for citizenship before contacting an immigration attorney. Deportation 

Deportation is the most severe consequence of immigration situations, and of which an immigration attorney is always recommended. Depending on the details of the deportation or inadmissibility, some non-permanent residents (commonly referred to illegal individuals) may apply for permanent residency through a family based petition. In addition to the foregoing, non-permanent residents may cancel deportation by seeking cancellation of removal for non-permanent resident, asylum, withholding of removal, waiver, or prosecutorial discretion.

As it relates to permanent residents, deportation may be cancelled by proving eligibility for Cancellation of Removal for permanent residents, withholding of removal, waiver, prosecutorial discretion or proof of prior U.S. Citizenship. If I am arrested, can I take my case to trial?

Yes. In Florida, a person charged with any crime has the right to a trial by jury or a bench trial. In a jury trial, the jury renders the verdict. In a bench trial, the judge, not a jury, renders the verdict. In all trials, the prosecution has the burden of proof. The Defendant has a fundamental right to testify or not testify. If the prosecution cannot meet its case beyond a reasonable doubt, then the charge will be dismissed or judgment rendered in favor of the defendant. If I am found guilty, will I go to jail?

It depends on the specific crime for which you are convicted. Florida has some of the toughest sentencing laws in the country. Many of Florida crimes carry mandatory prison sentences. If you are convicted of a crime that carries a mandatory prison sentence, the judge will have no choice but to sentence you to jail or prison.
